Hopscotch is committed to ensuring that patients treated through our software are not only receiving the highest quality medical care possible, but that any data collected is held to the highest standard possible in terms of confidentiality and secure storage and transmission. 
Hopscotch, its employees, and its affiliates strictly adhere to this Privacy Policy and the procedures outlined to ensure the confidentiality of the data and protected health information (PHI) shared by our Users. Hopscotch requires providers who participate in the Hopscotch platform to strictly adhere to this Privacy Policy and the procedures related to PHI of users.  Hopscotch does not sell lists or user data to any third parties. We may publish aggregate level data for publication or reporting purposes, however Users will be notified if they are agreeing to participate in a study in which this de-identified aggregate level data could potentially be shared and have the right to review and decline to participate in that program if they would like. 
If a provider suspects that there is abuse or neglect of a child taking place, they will contact the appropriate authorities, notify them about the situation occurring and disclose any relevant information.
We may also use and disclose PHI or other identifying information shared by our Users to:
  • Provide our services to you
  • Comply with federal, state or local laws that require disclosure
  • Respond to law enforcement officials or to judicial orders or subpoenas. 
  • Conduct research following internal review protocols and necessary approvals that ensure fidelity of the research and privacy protocol is taking place
  • Recommend treatment alternatives
  • Recommend consultation by a provider or the consumption of resources on our Site
  • Coordinate with healthcare providers, insurance companies and other healthcare related entities in order to provide Users with treatment options and support. 
  • Hopscotch may employ third party companies and individuals to help us provide our services, to provide the service on our behalf, to perform service-related services or to assist us in analyzing how our service is used
  • Help us improve the design and performance of our services and to better understand how Users use our services
  • Enforce the Terms of Service of our services
  • Respond to legal claims
  • Respond to your requests for services or transaction completion
  • Protect the rights, property, or personal safety of our services, Users, or the public.
  • When Hopscotch believes in good faith that the use and/or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request
  • If Hopscotch is involved in a merger, acquisition, or sale of all or a portion of its assets
 
 
Other Uses or Disclosures without Authorization
We may disclose information without your consent or authorization in the following circumstances. 
  • Child or Elder Abuse: if there is reason to believe that a child or elder has been subjected to abuse or neglect.
  • Health Oversight Activities: If we receive a notice from any federal or state level authorities because they are investigating our organization
  • Judicial and Administrative Proceedings: If you are involved in a court proceeding and a request is made for information. We will do our best to maintain confidentiality, however if we receive a lawful order from a court or administrative authority, a subpoena, search warrant or other valid request we may have to disclose and hand over the salient information to the appropriate personnel. 
  • Serious Threat to Health/Safety: If a patient communicates to one of our providers a specific threat of imminent harm against another individual or oneself or if the provider deems that there is clear, imminent risk of physical harm or mental injury being inflicted against another individual or oneself, the provider may make a disclosure to an appropriate authority to protect that individual from harm. 
  • Other Instances when Required by Law: We may disclose your information in any other instances when required by law by state or federal agencies or to law enforcement individuals, when we are required to do so. 
Information Hopscotch collects from Hopscotch Web Portal Users 
Hopscotch collects, retains and uses PHI and other information from Users including the following:
  • Account information that is collected for sign up including: name, email address, date of birth and phone number 
  • Usernames and UserIDs, which are used to identify you on Hopscotch 
  • Insurance information, including carrier, policy number 
  • Payment information, such as your credit card number, expiration data and security code 
  • Information from you if you are asking us questions, requesting information, or otherwise communicating with us.
The Hopscotch platform may also securely store and retain visit notes taken by any providers that Users see through the Hopscotch platform. Visit notes will only be visible to the patient and their provider and will include items such as session overviews, treatment goals, action plans and any follow up items for the patient to complete. This information may also include test results, diagnoses, medications, and any other information about your condition that is collected through our Services. If requested, records may be transmitted to another provider (on the Hopscotch platform) or otherwise, or transmitted to another provider for review.

Log Data
In addition, Hopscotch may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use Hopscotch. Hopscotch may also collect precise information about the location of your mobile device. 
 
Cookies
We may use various tracking methods or technologies (“Tracking Technologies”) to store or collect your Usage Information, including information about your visits to or interactions with our Site. If we use these Tracking Technologies, we use them to improve our Site and enhance your experience on our Site (for example to keep track of your specified preferences, or to help ensure that the security of your account has not been compromised). We may use some of the Tracking Technologies described below.
  • Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer's hard drive. We use "cookies" to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of Hopscotch. 
  • We may use Local Storage Objects (“LSOs”) such as HTML5 to store content information and preferences. Various browsers may offer their own management tools for removing HTML5 LSOs.  We may not recognize or respond to “do not track” technologies employed by your browser.
  • We may also occasionally use "web beacons" (also known as "clear gifs," "web bugs," "1-pixel gifs," etc.) that allow us to collect non-identifiable information about you. Web beacons are tiny images, placed on a web page or e-mail that can tell us if you have visited a particular area of our Website.

Protections on the Information Hopscotch Collects from Children
Hopscotch operates in compliance with laws, including COPPA (Children’s Online Privacy Protection Act):
In accordance with COPPA 
  1. this Privacy Policy describes all information collected from children, in addition to how it’s used and the disclosure practices 
  2. before children have the opportunity to create an account, engage in treatment exercises and/or conduct a consultation with a Hopscotch provider, their parent or legal guardian must sign a parental consent form.
  3.  the parent/legal guardian of the child receiving services through Hopscotch will have their own separate interface, where they can review the child’s progress, communicate with any providers that the child is seeing and view the child’s activity on the Site. 
  4. the child is only required to submit information that is directly relevant and can at any point, decide to not engage in an exercise if they are not interested. 
  5. Hopscotch will only keep the information gathered from children for the time necessary to perform the services, unless otherwise required by law.  
  6. Hopscotch allows parents to request deletion of their child’s information unless we are required by law to maintain the data 
Links on Site
This Privacy Policy applies only to the privacy of Users of our Services. If you follow links and move from our site to external websites owned or operated by other entities or individuals, you should read the privacy policies of those external websites carefully. The terms by which the owners or operators of those websites manage your information could differ from how we manage your information. We are not responsible for the practices of these third parties. 
Security
We use reasonable measures to help protect information from loss, theft, misuse and unauthorized access, disclosure or alteration. While security is of the utmost concern for us, no data storage system or transmission of data over the Internet, or through software, can be assured secure. We are not responsible for how unauthorized 3rd party parties use or disclose any data they be privy to.
 
Google API Disclosure
Hopscotch's use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.
 
California Shine the Light Law
California Civil Code Section 1798.83, known as the “Shine the Light” law, permits individuals who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. We will never disclose your personally identifiable information to third parties for direct marketing purposes without your authorization.

Changes to the Privacy Policy
We reserve the right to change the Privacy Policy at any point. The newest version will be maintained on this site. Your continued use of our Service submits that you are in acknowledgement of the current Privacy Policy. We recommend that you review regularly to stay informed on any changes. 
Agreement
I agree that I have received and read the notice of Privacy Policy. I understand that I may ask any questions I have at any time in the future. I also understand that I will be provided with an amended version of the Notice of Privacy Policies if there are any changes. I can also review the most up to date version of the Policy at any time within the agreements section of the Hopscotch platform.
